Right to equality |
The Supreme Court of Uruguay held that an additional solidarity tax imposed on the employees of the public sector during the public health emergency did not amount to a violation of right to equality. |
The claimant contested the constitutionality of the solidarity tax imposed on public servants to finance the Coronavirus Fund to support employees lost their job during the economic crisis surrounding the public health emergency. The claimant held that the differentiation between the groups of employees lacked an objective basis, therefore, it infringed right to equality. The Supreme Court of Justice upheld the establishment of the solidarity tax and argued that the different origin of income and the higher level of stability in the public sector justifies the differential taxation. Moreover, the temporal harm caused for public servants shall be outweighed by the benefits provided for persons facing with economic hardships during the public health emergency. |
