The Constitutional Court of Madagascar confirmed the constitutionality of an international treaty from the funding of measures for combatting Covid-19 pandemic in Madagascar. |
The Constitutional Court heard a referral by the President of the Republic concerning an international loan agreement between Madagascar and the International Development Association. The Malagasi Constitution requires from the President to send international agreements before their ratification to the Constitutional Court for validation. The Constitutional Court admitted the referral and confirmed, that the agreement was enacted under proper procedural regime, and its substance is also in conformity with the Constitution. |

The Constitutional Court of Madagascar ruled, that Parliament has the constitutional obligation to hold in person meetings even during the public health emergency, while public health requirements should be also respected. |
The Constitutional Court of Madagascar heard a referral by the President of the National Assembly concerning the amendment of the rules of procedure reflecting on the Covid-19 pandemic. The Malagasi National Assembly has the duty to send all amendments of its rules of procedure for validation to the Constitutional Court before its promulgation. The Constitutional Court admitted the referral and argued, that the Constitution expressly provides Antananarivo as the venue assigned for parliamentary seats, therefore, in person meetings are required even during the public health emergency. However, Covid-19-related restrictions shall be also respected during these seats such as limitations on gatherings. Most provisions of the parliamentary resolution were validated, however, the rules on online parliamentary meetings were annulled as unconstitutional. |
