March 3. 2023.   Constitutional Court of Malta Freedom of movement; right to a fair trial The Constitutional Court of Malta held that a 10000 euro fine imposed on a person allegedly breaching quarantine rules during the public health emergency was unconstitutional due to the violation of right to a fair hearing. A commissioner of justice imposed a 10000 euro ban on a person allegedly breaching quarantine rules during the public health emergency in Malta. The person concerned turned to the Constitutional Court and argued that his right to a fair trial was violated because a commissioner of justice should not impose such a huge fine, this competence belongs to the criminal courts.
