November 25. 2020. | Decision No. 36/PUU-XVIII/2020. | Constitutional Court of Indonesia | Right to life; right to work; right to equality | The Constitutional Court of Indonesia rejected an application contesting the allegedly insufficient level of governmental engagement for protecting public health workers during the Covid-19 pandemic. | The Constitutional Court of Indonesia heard a petition contesting the governmental measures as insufficients for the protection of public health workers, which amount to a violation of right to health; right to life; right to work and right to equality. According to the claimants, government should provide more protective equipments and free rapid testing for public health workers, while incentives for these persons might be also required, and due compensation is also expected for the family members of public health workers died in the epidemic. The applicants also stated, that several laws covering the required governmental measures have been interpreted on an unconstitutional manner by the authorities. The Constitutional Court rejected all of these applications and considered, that the interpretation required by the applicants is possible but not provided mandatorily by the Constitution; moreover, laws adopted during the public health emergency envisage proper assistance for the closest relatives of the victims.
