April 25. 2024.   Constitutional Court of South Korea Protection of personal data; right to privacy The Constitutional Court of South Korea held that the Government collected constitutionally sensitive personal information from individuals including their location data. An individual submitted an appeal to the Constitutional Court of South Korea and argued that the Government unconstitutionally collected the names, adresses, phone numbers and location data of several persons visiting the Itaewon area in Seoul for more than 30 minutes during a larger wave of the global pandemic. September 26. 2023.   Constitutional Court of South Korea Freedom of expression The Constitutional Court of South Korea held that a law which criminalized sending anti-Pyeongyang leaflets through ballons from South- to North Korea was nullified as unconstitutional. A law was passed in South Korea at the end of 2020. to criminalize sending anti-Pyeongyang leaflets through ballons from South- to North Korea. The South Korean campaign in North Korea caused remarkable tensions between the two countries and undermined the security of South Korean persons living in the border zone. The North Korean Government accused its southern counterpart that the outbreak of the Covid-19 pandemic in North Korea was also caused by these leaflets.
