The Supreme Court of Justice held, that the detention of a person with pre-existing illnesses should not amount to a threat of his right to phisical integrity in the light of the prison conditions in Honduras. |
The claimant was deprived from his liberty on a preventive basis and he was placed in a prison. He submitted a habeas corpus petition to challenge his inprisonment: in his view, the unhealthy and unsanitary conditions in the overcrowded prison violated his right to phisical integrity especially in the light of his pre-existing illnesses (for instance: high blood pressure and pulmonary affections). The lower court denied his request to replace the inprisonment with house arrest, and this was attacked before the Court of Justice. The Court of Justice found the habeas corpus action unreasonable, since there was no real risk that his right to personal integrity would be violated. |

The Supreme Court of Justice held, that the prison conditions in Honduras during the public health emergency did not threat the right to phisical integrity of the detained persons. |
The Supreme Court of Justice rejected a petition against the prison conditions in Honduras during the Covid-19 pandemic. According to the reasoning, detained persons received proper medical treatment, their treatment did not amount to torture or ill-treatment, their right to phisical integrity has not been in danger. |
