May 8. 2020. 20-065997STR-HRET Supreme Court of Norway Right to a fair trial The Supreme Court of Norway set aside a district court ruling ordering virtual hearing during the public health emergency when the arrest of a person was concerned. The appellant accused with attempted murder attacked a district court ruling ordering online hearing to decide from his arrest during the public health emergency. He considered that this court order violated his right to a fair trial. The district court ordered the online hearing despite the objections of the appellant, and rendered his detention, also the control of his correspondences. The Supreme Court held that the district court did not take into account the relevant ECtHR case law in its assessment, which amounted to a significant procedural error, therefore, the district court ruling was set aside, and the district court was ordered to examine, whether a phisical trial from arrest would be more appropriate. https://www.domstol.no/globalassets/upload/hret/decisions-in-english-translation/hr-2020-972-u.pdf
