The Constitutional Court of Togo held that the vaccination or negative PCR test required as a prerequisite of entering in the buildings of the administration was a constitutional state interference, however, the limitation of the geographical scope of this measure to two prefectures amounted to a discrimination. |
The Constitutional Court of Togo heard a case initiated by the Government to review the constitutionality of a mandatory vaccination or negative PCR test requirement imposed on the citizens of two prefectures to enter into any building of the public administration. The Constitutional Court noted that this measure served a legitimate aim and meant an adequate state interference within the extraordinary circumstances. However, the geographical scope of the measure was not convincingly justified, no evidence shows, that the two prefectures concerned with additional public health concerns. Therefore, the limited geographical scope of the measure amounted to a discrimination and the Government was called for extending the measure in the whole territory of the country. |
