CIVIL APPLICATION NO. 46 OF 2O2L |
Supreme Court of Uganda |
Access to justice |
The Supreme Court of Uganda held that the extension of deadlines in a judicial proceeding due to the hardships caused by the Covid-19 pandemic might be reasonable during the period of most virulent restrictions, however, overbrad references to the global pandemic and its implications should not be accepted for the justification of excessive delays. |
The applicant failed to submit an appeal against a judicial decision and for the justification of his delay, he referred to the hardships caused by the Covid-19 pandemic. The Supreme Court of Uganda held that during the first vawes of the pandemic, when lockdown was ordered, and far-reaching restrictions were implemented, the applicant might be prevented from submitting his appeal, however, he did not take action for a longer period during the later stages of the public health emergency, when the public health circumstances were more favourable and the restrictions were less severe. For these reasons, the claim was rejected and the appeal of the applicant was dismissed without the examination of the merits. |
