The Constitutional Court of Taiwan held that the storage of data provided for the National Health Insurance Database was unconstitutional, the relevant provisions should be amended within 3 years of the publication of this judgment. |
The Constitutional Court heard a challenge against the storage of data provided for the National Health Insurance Database. The Constitutional Court held that the lack of independent supervisory mechanism; the lack of right to opt out; and the lack of clarity regarding providing access to this information for the public health authorities amounts to unconstitutionality especially in the special post-Covid context. As a consequence, the legislation was ordered to amend the relevant provisions within 3 years of the publication of this judgment. |
